Who we are and these terms

Pure is operated by Pure - Monteiro Personal AI, a Swiss sole proprietorship (Einzelunternehmen) owned by João Araujo Monteiro, Via da Bos-cha 5, 7513 Silvaplana, Switzerland ("we", "us"). "Pure" is the brand name under which it offers the Service.

These Terms & Conditions ("Terms") are the agreement between you and us for your use of Pure (the "Service"). By creating an account or using the Service, you accept these Terms and acknowledge our Privacy Policy. If you don't agree, please don't use the Service.

What Pure is

Pure is an assistant powered by artificial intelligence. You are talking to an AI, not a person, and its voices are computer-generated. Depending on the permissions you give it, it can hold conversations, remember what you tell it and take actions, including running code, looking at and controlling your screen, mouse and keyboard, browsing the web and using other services you connect.

You stay in control of what it may do: the app asks before sensitive actions, and you can review or withdraw any permission at any time in Account > Privacy.

An early, evolving service

Pure is new and still being developed. Features, limits and plans may change, be added or be removed, and the Service may occasionally be unavailable, for example for maintenance. We don't promise any particular availability. Keep your own copies of anything important; don't rely on Pure as the only place it is stored.

Your account

You must be at least 16 years old to use the Service. If you are under 18, or under the age of majority where you live, you may only buy a paid plan with the consent of a parent or guardian.

Keep your sign-in details safe. You're responsible for what happens under your account, including what the assistant does at your request or with your permission. Tell us at once if you think someone else is using it.

Acceptable use

Don't use the Service, or ask the assistant, to: break the law; harm, harass, deceive, spy on or impersonate anyone; create sexual content involving minors; gain unauthorised access to any system or account; spread malware or spam; get around the security of other services; or do anything that could put people's life, health or safety at risk.

Don't use the assistant's voices or output to pretend to be a real person, or pass off AI-generated content as human-made where that would mislead someone. Don't record or clone anyone's voice or likeness without their consent.

The AI, speech and payment technology behind the Service is provided by third parties, and their usage policies also apply to what you do through the Service. In particular, don't use the Service to: develop or use weapons or to cause serious harm; create malware or run cyberattacks; run scams, fraud, phishing, spam or large-scale manipulation (for example fake reviews or political campaigns that mislead people); make or help make decisions that significantly affect someone's rights, such as about credit, jobs, housing, insurance, education or legal status, without a qualified human reviewing them; track, identify or profile people without their consent; or collect or process the data of children under 13.

Don't try to break, overload, reverse-engineer or get around the Service's security, permissions or usage limits, except where the law allows it regardless of this rule.

We may refuse, stop or limit requests that break these rules, and suspend accounts that do.

AI output and actions: your responsibility

AI replies can be wrong, incomplete, out of date or unsuitable for your situation, even when they sound certain. Check anything important before you rely on it.

Pure does not give professional advice. Nothing it says is medical, psychological, legal, tax, financial or investment advice, and it is no replacement for a qualified professional. It is not an emergency service: in an emergency, call your local emergency number.

Don't use the Service where a mistake could cause death, injury or serious damage, for example to operate vehicles, machinery, medical devices or critical infrastructure.

When the assistant takes an action (running code, changing or deleting files, controlling your screen, sending messages, making purchases, booking things or using a connected service), it does so because you asked for it or allowed it, including through an "always allow" permission. You are responsible for what you ask it to do and for checking the result. "Always allow" means the assistant no longer asks first, so only grant it for actions you're comfortable happening automatically.

Purchases, bookings, messages and other agreements the assistant makes with third parties at your request are between you and those third parties.

Other services

Services you connect (for example music, email or calendar services) are run by their own providers under their own terms. We're not responsible for them, their content or their availability, and connecting them doesn't mean they endorse or are affiliated with us. All product names and trademarks belong to their owners.

Plans, limits and payment

Pure has a Free plan and a paid Pro plan. What each includes, including the Pure Intelligence usage allowance, is shown in the app. To keep the Service fair and working for everyone, usage is limited, and the Free plan may be temporarily limited or paused when demand is very high.

Paid plans renew automatically until you cancel them, and are billed in advance by our payment processor. You can cancel at any time in Account > Your plan; you keep Pro until the end of the period you paid for. We don't refund partial periods, except where the law requires it.

If you live in the EU, EEA or UK, you have a 14-day right to withdraw from a paid plan. By starting a paid plan straight away, you ask us to begin at once and accept that, once the Service has been fully provided, you lose that right; if you withdraw earlier, we may keep a proportionate amount for the time used.

We may change prices for future periods. We'll tell you at least 30 days before a change affects you, and you can cancel before it does.

Your content and ours

You keep all rights to what you give the assistant and to what it creates for you, as far as the law allows rights in AI-generated material. You allow us to process your content only to provide the Service, as described in the Privacy Policy. We do not use it to train AI models.

The Service, its software, design and the Pure name and logo belong to us or our licensors. You may use the app for your own purposes; you may not copy, resell or redistribute it.

If you send us ideas or feedback, we may use them freely, with no obligation to you.

Warranties

We provide the Service with reasonable care. Apart from that, and as far as the law allows, the Service is provided "as is" and "as available", without any promise that it (or anything the AI says or does) will be accurate, complete, uninterrupted, error-free or fit for a particular purpose. This doesn't limit rights you have under the law of your country that can't be excluded by agreement.

Limitation of liability

As far as the law allows, we are not liable for indirect or consequential loss, lost profits, lost savings, lost or damaged data, or loss caused by the Service being unavailable, nor for loss resulting from actions the assistant took at your request or with your permission, from your breach of these Terms, from other services you connect, or from events outside our reasonable control (such as outages of networks, energy, service providers, attacks or official measures).

As far as the law allows, our total liability for all claims connected with the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose and CHF 100.

These limits don't apply to liability for intent or gross negligence, for death or personal injury, under product liability law, or to anything else that mandatory law says cannot be excluded or limited, including your statutory rights as a consumer where you live. Where a limit is not allowed, it applies to the greatest extent that is.

Indemnity

If a third party brings a claim against us because you broke these Terms or the law in using the Service, or because of an action you had the assistant take, you'll compensate us for the resulting damage and reasonable legal costs, to the extent you are at fault. This doesn't apply where mandatory consumer law says otherwise.

Ending the agreement

You can stop at any time by deleting your account in Account > Privacy > Delete my account.

We may suspend or close your account if you seriously or repeatedly break these Terms, if the law requires it, or to protect the Service or other people. Unless it would be unlawful or unsafe, we'll tell you why. If we stop offering the Service altogether, we'll give you at least 30 days' notice, so you can download your data, and refund any fees paid for the time after it ends.

Changes to these terms

We may update these Terms, for example when the Service or the law changes. We'll tell you about important changes in the app at least 30 days before they take effect. If you don't agree, you can delete your account before then; if you keep using the Service after that, the new Terms apply.

Transfer to our company

We may transfer the Service, including your account and these terms, to a company we set up to run Pure (or to a successor that takes over the Service), provided your rights under these terms and the Privacy Policy stay the same. We'll tell you in the app beforehand. If you don't agree, you can delete your account at any time.

Law and disputes

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

The courts at our registered place of business in Switzerland have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts where you live; any mandatory place of jurisdiction for consumers applies.

Please contact us first at [email protected]; most things can be settled quickly that way. We are not obliged to, and do not, take part in dispute-resolution proceedings before a consumer arbitration board.

General

If any part of these Terms is invalid, the rest remains in force, and the invalid part is replaced by a valid one that comes closest to its purpose. If we don't enforce a right straight away, we don't give it up. These Terms and the Privacy Policy are the whole agreement between us about the Service. The English version applies; translations are provided for convenience.

You may use the Service only where it is legal for you to do so and not if you are subject to sanctions that forbid it.
